In Virginia, marijuana is classified as a Schedule I substance, aligning with federal classification. Adults in Virginia are allowed to possess up to one ounce of cannabis for personal use. The new law also permits "adult sharing" of up to one ounce of marijuana or an equivalent amount of marijuana products between persons 21 years of age or older without remuneration. Possession of a larger quantity of marijuana does not alone constitute proof of intent to distribute. However, distributing more than one ounce but less than five pounds of marijuana is considered a felony, punishable by at least one year but not more than ten years in jail. Additionally, any person who sells or possesses with intent to sell drug paraphernalia intended for illegal use of marijuana is guilty of a misdemeanor, punishable by no more than one year in jail and a fine of no more than 2,500 USD. Adults over 21 are allowed to cultivate up to four plants per residence.

Virginia's cannabis policy has evolved over the years. In 1979, medical cannabis was legalized for patients with glaucoma. Subsequently, in 1998, cannabis laws were tightened, and cannabis was legalized for chemotherapy patients. Governor McAuliffe signed two bills in 2015 to decriminalize cannabis oil for patients with epilepsy. In 2018, the Virginia Board of Pharmacy approved five cannabis dispensary companies. In 2020, minor possession of cannabis was decriminalized, and the first medical cannabis dispensary opened. The most recent development occurred in 2021 when recreational use of marijuana possession and cultivation was legalized.
