Pennsylvania Marijuana Laws
In Pennsylvania, marijuana is classified as a Schedule I drug, both at the state and federal levels. Possession of 30 grams or less of flower or eight grams or less of hashish is considered a misdemeanor, punishable by 30 days in jail or a 500 USD fine. Distribution of 30 grams or less of marijuana without compensation is also a misdemeanor, punishable by up to 30 days in prison and a fine of up to 500 USD. The sale of more than 30 grams is a felony, punishable by 2.5 – 5 years in jail and a 15,000 USD fine for a first offense, and between 20 years and life imprisonment for subsequent offenses. Possessing or selling paraphernalia is a misdemeanor punishable by a maximum of 6 – 12 months incarceration and a fine of not more than 2,500 USD.
Cannabis Policy Reform Timeline
The journey of cannabis policy reform in Pennsylvania includes significant milestones. In 2016, Governor Wolf signed Senate Bill 3, legalizing cannabis for medical use for patients with seventeen qualifying conditions. In 2017, the Pennsylvania Democratic State Committee urged the Democratic Party to support a cannabis legalization bill. House Bill 163 was passed in 2018 with the slogan “Smoke a Joint, Lose Your License,” ensuring that anyone caught possessing illegal drugs would lose their driver’s license for six months. Governor Wolf continued to urge the Senate and House to reconsider the cannabis legalization bill for economic purposes in 2019 and 2020. Improvements were made to the PA medical marijuana program in 2021, and in 2022, legislation is pending to decriminalize cannabis statewide.
Possession Limits in Pennsylvania
Recreational possession of marijuana is not allowed in Pennsylvania. However, medical patients are permitted a 30-day supply but cannot refill the prescription until the last seven days of each month.
