Ohio Marijuana Laws
Marijuana is classified as a Schedule I substance in Ohio, consistent with federal classification. Possession of fewer than 100 grams is considered a minor misdemeanor, punishable by a 150 USD fine. Penalties for cultivation of marijuana are the same as those for possessing an equivalent amount, in weight, of marijuana. Gifting of twenty grams or less is also a minor misdemeanor, punishable by a maximum fine of 150 USD. Possession of marijuana paraphernalia is classified as a minor misdemeanor, with a maximum penalty of 150 USD, possible community service, and suspension of the offender’s driver’s license for six months to five years.
Cannabis Policy Reform Timeline
Ohio has seen changes in its cannabis laws over the years. In 1975, minor possession of cannabis was decriminalized, and Governor Rhodes signed the law. In 2015, a ballot initiative called Issue 3 failed to gain support for recreational legalization. Governor Kasich signed a bill in 2016 to legalize medical marijuana for qualifying conditions. The state issued its first dispensary license in 2018, and licensed sales of medical marijuana began in 2019. Currently, in 2022, a ballot initiative to allow voters to legalize marijuana for adult use is gaining signatures.
Possession Limits in Ohio
Medical patients in Ohio can possess a ninety-day supply of marijuana, with inhaled forms not permitted. Possession of marijuana for recreational use remains illegal.
