The Status of Cannabis Legalization in Montana
Montana Marijuana Laws
In Montana, marijuana is classified as a Schedule I substance, consistent with federal law. Adult residents are allowed to possess up to one ounce of cannabis. Possession of more than one ounce but less than two ounces of marijuana is considered a civil infraction, and individuals can choose to either pay a fine of up to 200 USD or complete four hours of community service. Distribution of more than two ounces of marijuana, whether with or without compensation, is punishable by a mandatory minimum of one year in prison, a maximum sentence of life imprisonment, and a fine of up to 50,000 USD. Individuals aged 21 and older are legally permitted to grow no more than two plants and two seedlings. Possession, manufacture, or delivery of paraphernalia is classified as a misdemeanor, punishable by up to six months of imprisonment and/or a fine of 500 USD.
Cannabis Policy Reform Timeline
Montana has experienced several changes in its cannabis laws over the years. In 2004, voters passed the Montana Medical Marijuana Act, establishing the Montana Medical Marijuana Program. The I-182 Montana Medical Marijuana Initiative in 2016 eliminated many of the stricter requirements of SB-423 and added chronic pain and Post-Traumatic Stress Disorder (PTSD) as qualifying conditions. In 2017, SB433 was enacted, creating more detailed regulations, allowing additional chemical manufacturing of marijuana products, and implementing a tax on gross sales. SB265 in 2019 increased the tax on medicinal marijuana providers while making it easier for patients to obtain cannabis from other providers. The most recent significant change came in 2020 with the passage of I-190, legalizing adult-use recreational marijuana. Criminal possession or use of less than one ounce of marijuana no longer applies under state law for adults 21 and older, who are also permitted to plant and cultivate up to four mature marijuana plants and four seedlings. Sales for adult-use marijuana began on January 1, 2022.
