Possession of more than 1.5 ounces of marijuana can lead to a prison term not exceeding one year and a fine not exceeding 2000 USD. Possession of marijuana paraphernalia in cases where the marijuana possessed was ten grams or less is a civil violation punishable by a fine between 100-200 USD. Registered medical cannabis patients in Illinois may cultivate up to 5 plants that are 5 inches or taller.

Cannabis prohibition began in Illinois in 1931 due to federal prohibition. The Cannabis Control Act in 1978 allowed for medical marijuana, but the Police and Human Services Department did not act to establish the program. The Compassionate Care Act was passed in 2013 to legalize medical cannabis for specific medical conditions. In 2016, personal use of cannabis up to ten grams was decriminalized. Recreational legalization was proposed but not voted on in 2017. The medical program and qualifying conditions were expanded in 2018. The Illinois Cannabis Regulation and Tax Act was passed in 2019 to legalize cannabis use for adults in Illinois, with recreational use beginning in January 2020, and cultivation becoming legal for medical patients.
