In Delaware, marijuana is classified as a Schedule I substance, aligning with federal regulations. Personal use of marijuana is limited to one ounce or less. Possessing more than one ounce but less than 175 grams of marijuana is considered an unclassified misdemeanor, with possession classified as a class B misdemeanor if aggravating factors are involved. Distribution, sale, or manufacture of fewer than 1,500 grams is considered a felony. Possession of drug paraphernalia for personal use of marijuana incurs a civil penalty of not more than $100.
Cannabis Policy Reform Timeline
Delaware's cannabis policy reform began in 2011 when Governor Markell signed legislation legalizing medical cannabis for patients with severe and debilitating conditions. The first medical cannabis clinic opened in Wilmington, DE, in 2015. Efforts to legalize cannabis for adult use have been ongoing from 2017 to 2021, with House Bill 150 to legalization being blocked by the General Assembly in 2022. Despite this setback, marijuana supporters continue to push for legalization on the ballots. In 2023, recreational marijuana was finally legalized, and plans for expungement of weed convictions within the year have been made.
Possession Limits in Delaware
To possess marijuana in Delaware, you must be at least 21 years old and have a government ID. Individuals meeting these requirements can possess one ounce or less of leaf marijuana, 12 grams or less of concentrated cannabis, or cannabis products containing 750 milligrams or less of delta-9-tetrahydrocannabinol. Registered patients may possess up to six ounces but are limited to purchasing three ounces every 14 days from state-regulated compassion centers.
